San Francisco City Attorney Dennis Herrera began legal proceedings Thursday to remove suspended Supervisor Ed Jew, who is accused of not living in the Sunset District he represents, among other charges.
Herrera filed a civil suit in San Francisco Superior Court on Thursday, alleging Jew did not meet city residency requirements when he ran for the District 4 seat on the Board of Supervisors.
"My action against Supervisor Jew that we filed today is simply based on the fact that he does not meet the residency requirements as outlined in the San Francisco city charter, delineating the requirements to hold office," explained Herrera. "There is overwhelming evidence that he did not satisfy the residency requirement. The law is clear that you need physical presence and the intent to remain at that location and Supervisor Jew didn't satisfy either prong."
Herrera added that his suit is likely to resolve the issue of whether Jew should be permanently removed from office more quickly than a proceeding initiated by the city's ethics commission.
Jew is also facing criminal charges of perjury and election code violations filed by the district attorney. In another federal case, he is accused of mail fraud in connection to bribes he allegedly accepted from Sunset District businessmen.
Mayor Gavin Newsom suspended Jew in September for official misconduct after the FBI leveled the fraud charges against the supervisor.
