East Bay Freeway Shooters Get Prison Time

FREMONT (CBS 5 / BCN) ― Two men have pleaded guilty to felony assault with a deadly weapon in connection with a series of highway pellet gun shootings in Fremont last spring, according to the California Highway Patrol and court records.

Shawn Phillip Wagner of Mariposa and Rojelio Samuel Gomez of Fremont, both 21, entered their pleas before Alameda County Superior Court Judge Dennis McLaughlin on Nov. 16 in connection with an agreement that calls for each of them to serve three years and eight months in state prison and pay restitution to their 42 victims.

Each pleaded guilty to two counts of felony assault with a deadly weapon and one felony count of vandalism. They are scheduled to be sentenced by Judge Kevin Murphy on Dec. 18.

The CHP arrested Wagner and Gomez on May 21 in connection with shootings. Most occurred on Interstate Highway 680 between Mission Boulevard and Washington Street in Fremont, and nine shootings happened on Interstate Highway 880.

The shootings resulted in damage to several vehicles and minor injuries to one person.

Wagner and Gomez were each charged with 42 counts of felony assault with a deadly weapon and 43 counts of felony and misdemeanor vandalism, but they were allowed to plead guilty to only three felony charges in their plea agreement.
