Thomas Cunningham and his daughter were walking home from this liquor store in Hayward when he was shot and killed Tuesday night.

A Hayward man walking his dogs with his 13-year-old daughter was fatally shot in front of her after one of the dogs sniffed the gunman's leg, authorities said Wednesday.
Thirty-eight-year-old Thomas Cunningham died at Eden Medical Center in Castro Valley after the shooting outside a Hayward liquor store on B street near Vermont Street Tuesday night.
Police said the gunman asked Cunningham to hold his dogs back and objected when one of them a German shepherd sniffed his leg.
"One of their dogs approached the man who would end up being the suspect shooter, and he was unhappy with the dog approaching him and asked them to get the dog away from him," said Hayward police Lt. Chris Orrey.
Cunningham was just leaving the liquor store, where he had bought ice cream for his daughter about 10 p.m. That's when police said the incident occured and the suspect "exchanged some words" with Cunningham.
"The suspect became angry, pulled out a handgun and shot the victim right in front of his daughter," Orrey said.
The gunman ran off after the shooting. Investigators said they had a description of the suspect but had yet to identify him.
Orrey emphasized that Cunningham's dogs were unleashed but were not behaving aggressively.
