The state Senate on Tuesday approved a bill authored by Assemblyman Mark Leno to proclaim May 22 as Harvey Milk Day in honor of the San Francisco supervisor who was killed in 1978.
AB 2567 was approved by a 22-13 vote and will now go back to the Assembly for a final vote before going to the governor for approval, according to the office of Leno, D-San Francisco.
"Both houses of our Legislature have now honored Harvey Milk's important civil rights legacy, and I am hopeful the governor will sign this bill so that California officially recognizes the message of hope and pride Harvey's life inspired," Leno said in a prepared statement.
Milk was born May 22, 1930 and in 1977 became the first openly gay elected official for a major U.S. city. Milk and Mayor George Moscone were shot and killed by former Supervisor Dan White on Nov. 27, 1978.
The bill was sponsored by Equality California and will not impact the state budget nor offer the day off work for state workers or school employees, Leno's office said.
