Santa Clara DA Seeks State Review Of De Anza Case

SANTA CLARA (AP) ― The state attorney general's office has agreed to review the case of an alleged gang-rape of a teenage girl by De Anza College baseball players to determine if county prosecutors erred by not filing charges.

Hoping to ease public outcry over her decision not to prosecute the case, Santa Clara County District Attorney Dolores Carr asked Attorney General Jerry Brown's office to decide independently whether her decision was appropriate.

Brown's office agreed, and will look at the case to "determine whether there was any abuse of discretion on the part of the district attorney," said Brown spokesman David Kravets.

If Brown's office finds that charges should have been filed, it can ask Carr to re-evaluate the case or simply file charges itself in state court.

The allegations stem from a March birthday party at the home of a De Anza infielder where the teenage girl claims she was gang-raped.

Eight ball players were suspended from the Cupertino community college team after the alleged rape was reported.
Sheriff's investigators took DNA samples from an unspecified number of partygoers, including some players.

Carr said last month her office did not have enough evidence to file charges in the case.
