Girl Testifies On Santa Rosa Gang Rape

 CBS 5 CrimeWatch
SANTA ROSA (BCN) ― A 16-year-old Santa Rosa girl testified Tuesday in Sonoma County Superior Court that four males forced her into a car, drove her to Comstock Middle School and took turns raping her in April.

The girl was 15 years old at the time and said she was impregnated during the sexual assaults and had an abortion.

Her testimony came at the preliminary hearing for Oscar Anibal Magana-Aristando, 20, Salvador Armando Rivas, 18, and Alejandro Corado, 31, all of Santa Rosa. The purpose of a preliminary hearing is to determine whether there is sufficient evidence for a case to proceed to trial.

The suspects are charged with rape in concert by force or violence, kidnapping, assault with a deadly weapon, oral copulation in concert by force, and giving a minor a controlled substance.

A 13-year-old boy also was arrested in connection with the April 6 sexual assault and his mental competency is at issue in juvenile court.

The girl said she was walking on Coffey Lane in west Santa Rosa to her aunt's house as it grew dark around 7:30 p.m. when the suspects passed by in a sport utility vehicle.

A passenger in a rear seat asked if she needed a ride and she said no, but the vehicle passed by again. When she refused a ride a second time, the car stopped and she was forced inside and driven to the nearby middle school, she said.

She was pulled from the car, held down and sexually assaulted by the four suspects, she said. The girl testified when she bit the penis of one of the suspects she was kicked in the ribs and a white powdery substance that numbed her face was poured down her throat. The prosecution alleges the drug was methamphetamine.

The suspects then drove her to a shopping center on Fourth Street and Farmer's Lane in Santa Rosa, the girl said. She then got a ride from a man in a white truck to another shopping center in east Santa Rosa and walked home to her grandmother's house, the girl said.

The girl testified she did not want to tell anyone about the sexual assaults but agreed to tell Santa Rosa police four days later.

The suspects were arrested on April 10 and April 13, and are being held in the Sonoma County jail. The preliminary hearing will continue Nov. 4.
