Prosecutors filed the charges Tuesday against 19-year-old Quran Jones, who remains in the hospital after being shot by police. He's been upgraded from fair to good condition since the Oct. 21 incident. Authorities say Jones beat 23-year-old Scott Hawkins with a baseball bat during a rampage in their five-person suite. Officers opened fire after they say Jones lunged at them with a knife.

Botchvaroff had just left his arraignment on auto theft charges stemming from an Oct. 31 arrest.

The California Department of Corrections and Rehabilitation filed the plan Friday in response to a federal court order. It includes a 1,734-bed facility in Stockton at a cost of $1 billion. The construction would be paid for out of a $7.8 billion pot of money the Legislature set aside to reduce prison overcrowding two years ago.
