Peninsula Man Pleads No Contest To Abusing Father

 CBS 5 CrimeWatch
FOSTER CITY (AP) ― A Foster City man faces up to five years in prison after pleading no contest to elder abuse for hitting his 81-year-old father in the head with a hammer.

Authorities say 58-year-old Jayantibhai Patel wanted to leave his father in a nursing home and return to India. He hit him twice with a hammer because he thought his father had to be hospitalized before a nursing home would accept him.

When his father did not lose consciousness after the blows, authorities say Patel called 911 and told police his father had fallen.

Prosecutors dropped an attempted murder charge after Patel insisted he only intended to injure his father, who uses a wheelchair.

Patel's due to be sentenced in San Mateo County Superior Court in November.
