Young Gilroy Boy Shot During Alleged Gang Fight

GILROY (CBS 5) ― A Gilroy woman's boyfriend was arrested Thursday after dropping off her 2½ -year-old son at a hospital emergency room with a gunshot wound following an alleged gang fight, police told CBS 5.

Michael Guajardo, 28, described by police as a known gang member, was being held on a parole violation and a charge of felony child endangerment.

Guajardo was seen by staff members at St. Louise Hospital dropping off the wounded boy about 2:15 p.m., Sgt. Jim Gillio said.

The boy was listed in critical but stable condition after being flown by helicopter from the hospital to a regional trauma center for treatment.

Hospital witnesses provided a description of Guajardo's car and police stopped and detained him a short time later along with the boy's mother; officers said it appeared they were returning to the hospital at the time.

Gillio said Guajardo told detectives that he was alone with the boy at his girlfriend's home in the 9000 block of Kern Avenue when a rival gang member knocked on the door. 

Guajardo claimed he opened the door and a fight ensued, with the other man pulling a handgun that discharged during the struggle and a bullet struck the young boy's torso, Gillio said.

Guajardo told police that the other gang member fled the home after the gun went off and he immediately drove the child to the hospital.

Detectives said the shooting remained under investigation Thursday night.
